These Terms & Conditions (“Terms”) govern the use of the Qont website and the supply of services by Qont, being services provided by Qont Inc. across its trade and service operations. By accessing the website, submitting an enquiry, requesting a quote, making a booking, or receiving services from Qont, the customer or user agrees to these Terms.
I. Scope
These Terms apply to website use, enquiries, quotes, bookings, service requests, and the supply of services by Qont to individuals, businesses, property managers, contractors, commercial clients, and any other customer category. These Terms apply across all Qont trade and service lines unless specific written terms are issued for a particular service.
II. Website Use
The Qont website may be used only for lawful purposes. Users must not misuse the site, interfere with its operation, attempt unauthorised access, reproduce or copy content without permission, or use the site in a way that disrupts Qont’s systems or misrepresents the user’s identity or intentions. Website content is provided for general information only and may be updated, corrected, or removed without notice. Qont does not guarantee that website content is complete, current, uninterrupted, or error-free at all times.
III. Enquiries and Bookings
Submission of an enquiry, service request, or booking request does not guarantee acceptance, availability, attendance, or service delivery. Qont may review, accept, refuse, prioritise, reschedule, or decline enquiries and bookings at its discretion. Booking dates and times are scheduled on a best-effort basis only and may change due to availability, safety conditions, weather, access issues, staffing, supply issues, or other operational circumstances unless Qont confirms otherwise in writing.
IV. Quotes and Estimates
All quotes, estimates, and pricing indications issued by Qont are estimates only and remain subject to site conditions, actual scope, access conditions, availability, labour requirements, materials, and operational review before acceptance. Quotes may change if the actual work required differs from the information initially provided or if site conditions require additional work, equipment, attendance, or time.
V. Service Delivery
Qont will use reasonable efforts to provide services professionally and in accordance with applicable standards relevant to the service provided. Service scope may be limited by site access, customer instructions, safety conditions, material availability, equipment condition, legal requirements, or issues outside Qont’s control. Where services involve inspection, testing, compliance, or safety observations, those observations reflect the condition of the relevant asset, system, or site at the time of service only and do not guarantee future performance, future safety, or ongoing compliance.
VI. Customer Responsibilities
Customers must provide accurate information when making enquiries, requesting quotes, or booking services. Customers must have lawful authority to request the work. Customers must provide safe and reasonable site access, disclose known hazards, cooperate with booking and service requirements, and ensure the site is suitable for attendance and service delivery. Customers remain responsible for the condition of their premises, equipment, assets, systems, and any information supplied to Qont. If customer-side conditions prevent work from proceeding safely, lawfully, or efficiently, Qont may suspend, refuse, reschedule, or vary the service.
VII. Payment
Payment is due in accordance with the invoice terms issued by Qont. Qont may suspend services, refuse further attendance, or withhold records, reports, certificates, tags, or related documents where payment is overdue. Qont may also exercise any other lawful rights available in relation to unpaid amounts.
VIII. Cancellations, Access Failure, and Reattendance
Qont may charge a reasonable call-out fee, cancellation fee, reattendance fee, or standby fee where a booking is cancelled on short notice, site access is unavailable, the customer is not ready, required equipment or areas are not accessible, or the work cannot proceed due to customer-side circumstances. If additional attendance is required because work could not proceed for customer-side reasons, additional charges may apply.
IX. Privacy and Data Handling
Qont may collect, store, and use contact details, enquiry information, booking information, site information, service records, and other information reasonably required to respond to enquiries, issue quotes, manage bookings, provide services, process invoices, maintain records, and operate its business. By using the website or requesting services, the user or customer consents to that handling. Qont may disclose such information to personnel, contractors, service providers, payment providers, technology providers, insurers, advisers, or authorities where reasonably necessary for operational, legal, safety, compliance, or payment purposes. Qont does not require unnecessary personal information and will use information only for legitimate business, compliance, and service purposes.
X. Limitation of Liability
To the maximum extent permitted by Australian law, Qont is not liable for indirect loss, consequential loss, loss of profit, loss of business, business interruption, delay loss, loss arising from customer-provided information, site conditions, third-party failures, weather events, utility interruptions, product failures outside Qont’s control, or circumstances beyond Qont’s reasonable control. Qont’s services, quotes, scheduling, and website content are provided on an as-available and best-effort basis unless Qont expressly agrees otherwise in writing. Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable Australian law.
XI. No Guarantee of Availability or Continuous Website Access
Qont does not guarantee continuous website availability, immediate response times, guaranteed booking slots, or uninterrupted service access. Website functions, forms, pages, and content may change or be unavailable from time to time.
XII. Intellectual Property
All website content, branding, trade names, service descriptions, templates, text, graphics, and materials published by Qont remain the property of Qont or its licensors unless otherwise stated. No user may copy, reproduce, adapt, republish, or exploit Qont content without prior written permission.
XIII. Variations to Terms
Qont may update or revise these Terms from time to time. Updated Terms apply to future website use, enquiries, bookings, and services from the date they are published or otherwise issued.
