Terms & Conditions / Service Agreement Acceptance
Governing Law: Australia (Commonwealth of Australia)
This Terms & Conditions / Service Agreement Acceptance (“Acceptance”) is used by Qont for residential, commercial, and industrial clients. This document records the client’s acceptance of the applicable quote, the defined scope of work, and Qont’s Terms & Conditions as one combined service package.
I. Parties
This Acceptance applies between Qont, being services provided by Qont Inc., and the client identified below.
II. Acceptance of Quote, Scope, and Terms
By signing this Acceptance or by providing written acceptance by email, the client confirms acceptance of the applicable quote, the scope of work described in that quote or any attached service description, and Qont’s Terms & Conditions. These documents are to be read together and form the basis on which Qont may schedule, attend, and perform the requested services.
III. Scope of Work
The client acknowledges that Qont’s services are limited to the work described in the accepted quote, service description, or other written scope issued by Qont. Any work not expressly included in the accepted scope is outside the original service package unless later approved as a variation.
IV. Payment Agreement
The client agrees to pay all quoted amounts and all approved variation amounts in accordance with Qont’s invoice terms. The client acknowledges that Qont may issue invoices, payment requests, or related billing documents in accordance with the accepted quote and Qont’s Terms & Conditions.
V. Variations
The client acknowledges that additional work, changed scope, extra equipment, access issues, unsafe conditions, customer-requested changes, or site-related circumstances may result in additional charges. Where practicable, such variations are to be approved before the additional work proceeds. If a variation is necessary because site conditions, customer instructions, or access circumstances differ from what was originally disclosed, Qont may issue revised pricing, revised scope, or both.
VI. Client Authority
The client confirms that the client has lawful authority to request the services, to approve the quote and scope, and to allow Qont to attend the relevant site or property. If the client is acting on behalf of a company, owner, occupier, manager, or other principal, the client confirms that the client is authorised to bind that party to the accepted quote, scope, and Terms & Conditions.
VII. Reliance on Information Provided
The client acknowledges that Qont may rely on the information provided by the client when preparing the quote, scheduling the work, and determining the expected service scope. If the information supplied by the client is incomplete, inaccurate, or materially different from actual site conditions, Qont may vary the scope, the attendance, the timing, the pricing, or the service method as reasonably required.
VIII. Method of Acceptance
This Acceptance may be completed by either of the following methods. The client may sign this document and return it to Qont, or the client may send written acceptance by email confirming acceptance of the quote, scope of work, and Qont’s Terms & Conditions. Either method constitutes valid written acceptance.
